    He should have not been allowed to wear the uniform of a US soldier during his court-martial IMO

    FORT BRAGG, N.C. – U.S. Army Sgt. Bowe Bergdahl made his first appearance before a military judge to face charges of desertion and misbehavior before the enemy.

    Bergdahl was arraigned Tuesday during a short hearing. He deferred entering a plea and did not decide whether he wants to face a court-martial with a jury or one with just a judge.

    Bergdahl answered “yes” and “no” to questions about whether he understood his rights and the court proceedings. He wore an Army dress uniform with a dark blue jacket and pants and had closely cropped hair. He mostly sat still in his chair and walked with his head down as he left the courtroom.

    The arraignment was held at Fort Bragg. If convicted at a general court-martial, Bergdahl could get life in prison on the misbehavior charge and up to five years for desertion.

    Bergdahl, 29, of Hailey, Idaho, walked off his post in eastern Afghanistan’s Paktika province on June 30, 2009. He was released in late May 2014 as part of a prisoner swap, in exchange for five detainees in Guantanamo Bay.

    A preliminary hearing officer initially recommended a special court-martial, which is a misdemeanor-level forum. But earlier this month, the Army announced Bergdahl would face the more serious general court-martial.

    While the military typically follows the recommendation from the preliminary hearing known as an Article 32, it’s not unheard of for a high-ranking general to make a different decision, said Walter Huffman, a retired major general who served as the Army’s top lawyer.

    Huffman was surprised the more serious general court-martial was chosen, but he said the approach will allow the court to thoroughly consider the case with all punishments available.

    “It’s kind of: ‘Let’s let the system decide. Let’s keep our options open,'” he said.

    The charge of misbehavior before the enemy was used hundreds of times during World War II, but scholars say its use appears to have dwindled in conflicts since then. Legal databases and media accounts turn up only a few misbehavior cases since 2001, when fighting began in Afghanistan, followed by Iraq less than two years later. In contrast, statistics show the U.S. Army prosecuted about 1,900 desertion cases between 2001 and the end of 2014.

    Bergdahl hasn’t talked publicly about what happened, but over the past several months, he spoke extensively with screenwriter Mark Boal, who shared about 25 hours of the recorded interviews with Sarah Koenig for her popular podcast, “Serial.”

    Bergdahl’s attorney Eugene Fidell said politicians and others have been using Bergdahl as a talking point to push their own agendas for months. The more the public can hear Bergdahl’s own words, the better, Fidell told The Associated Press earlier this month.

    In the first episode of “Serial,” Bergdahl said he walked off his base to cause a crisis that would catch the attention of military brass. He wanted to warn them about what he believed were serious problems with leadership in his unit. And he wanted to prove himself as a real-life action hero, like someone out of a movie.

    “I was trying to prove to myself, I was trying to prove to the world, to anybody who used to know me … I was capable of being what I appeared to be,” Bergdahl said. “Doing what I did was me saying I am like Jason Bourne. I had this fantastic idea that I was going to prove to the world I was the real thing.”

    The army he follows is most vile and biggest joke. Sadly he's too gullible to understand that.

    Soldiers have been fighting wars for commanders they disagree with for thousands of years. a soldier doesn't question he fights on the battlefield. If that's the the case then he should have never joined the military. In ancient times he would have met the sword.

    How does deserting because you don't like the commanding of your unit solve anything? A soldier's job is to follow orders. He sure didn't try to be a Jason Bourne when the Taliban found him.

    Couldn't agree more. Don't question something you knowingly joined. No one or no government is perfect, we all know that, but the people he sympathizes with are the worst. They are the joke. To say the US and the men and women giving their lives are the biggest joke, is the joke. The US should pull out of every problem area and we'll see who the joke is. We'll see where the world goes without the world police. He thinks radical/extreme religion and killings don't exist. I'm guessing he'll learn that lesson soon and realize what he did and the truth. BUT, just my opinion. :dontknow:

    Actually, never mind my opinion. It's one of billions, it doesn't matter. Bottom line....take off the uniform men and women have worn for years and years and years fighting and dying for freedom and their country. :mad:

    They don't mention like six Rangers or something tidied trying to get him back. What point did he prove to the families and soldiers he got killed and wounded looking for him??

    I think the Podcast "Serial" screwed his pooch. Up until his taped conversation the media was kind of painting him as a victim. Now by his own mouth I think the Army had to act. He had O in his corner and now I think he is cooked.

    I did some reading into him last night. Did you know he got discharged from the coast guard after basic training becuase they saw how fucked up the guy is? He's 100% guilty of what he's charged with, but I think we need to look into how he got into the Army after his coast guard debacle.
