Actor Sues 'The Simpsons' Maker For Infringing on His 'Goodfellas' Character
    October 21, 2014 - GamePolitics Staff

Actor Frank Sivero, who played Frankie Carbone in the popular movie Goodfellas, has filed a lawsuit against the creators of The Simpsons, seeking $250 million for "ripping off" the character he played in the 1990 film (the lovable gangster Louie). The lawsuit claims that The Simpsons has generated around $12 billion in total revenue through TV, a movie, and video games over the years; meanwhile Sivero "has suffered, and continues to suffer severe financial damages in the form of lost income [the] Plaintiff should have received in compensation for his name and likeness being used in the manner described herein."

Sivero's 12-page complaint also alleges that The Simpsons producer James L. Brooks was "highly aware of who Sivero was, the fact that he created the role of Louie, and that The Simpsons character Louie would be based on this character."

You can check out the lawsuit here (PDF).

Just off the surface, he's suing because they copied "his character", it's what he played and gave it a personality. No different then what De Niro or Pesci did, they took a character written and owned by the film producers and brought them to life. This guy doesn't own anything, and he can barely argue it's in his likeness.

I'm reminded of one the more absurd lawsuits. You know how you see warnings on liquors bottles that alcohol can cause birth defects?

This comes a case in Oregon where a woman gave birth to a child with severe deformities. She had been drinking a fifth of Jack Daniels on a daily basis during her pregnancy. Apparently she needed a warning label to help her understand that a quart of liquor a day might be harmful to a fetus.

Her lawsuit was thrown out, but the liquor industry still paid attention and that's why you see the warning labels these days.

Of course, if there was anybody who should have been sued, it was the assholes who sold her the whiskey each and every day.

I love watching the TV commercials with obviously fake car stunts. the warning always says" Do not attempt". Maybe if we eliminated these warnings we could improve the gene pool.

Your story reminded me of this pregnant gal once. I took a special lab class in collage back in '85, this one gal was either in her late 20's or early 30's and was at least 7 months pregnant, taking the class too. During one of the breaks, she stepped in the hall and lit a cigarette and was dragging it deep (this was still allowed back then). A few people and even the professor just said in passing, "you know the smoking is bad for your baby"! She answered as serious as can be, "it's luck I'm not doing anything stronger", people nervously chuckled thinking she wasn't serious. Then everyone realized she was, and they just sort of moved away from her, everyone pretty much stayed away from her after that. That kid would be in it's late 20's now, I wonder how it turned out?

Frank Sivero, real-life ‘Goodfellas’ Frankie Carbone, sues deli over pic promoting sandwich

The 62-year-old actor claims his likeness was used by Deli Belly in El Cajon, Calif., to promote the 'Frankie Carbone' sandwich. Sivero took pictures with customers at the eatery earlier this year but then found his image plastered next to the Italian combo.

Once he thawed out of that meat locker, Frankie Carbone went straight to his lawyer.

Frank Sivero, who famously played wiseguy Carbone in the gangster flick “Goodfellas,” is suing a Southern California deli for using his picture in ads for a sandwich named after the fictional mobster.

The 62-year-old actor claims in court docs that he ate at Deli Belly in El Cajon, Calif., in March “and after eating, agreed to have his photograph taken with patrons,” according to the Courthouse News Service.

Months later, Sivero’s mug was plastered on the eatery’s website, Facebook page and Yelp reviews alongside the “Frankie Carbone” sandwich.

Sivero claims he never gave permission, or got paid, to be used in any company advertising.

Checked Friday evening, no pictures of Sivero appeared on any of the named sites.

The sandwich — served on a roll with “genoa salami, mortadella, hot cappy, deluxe ham and provolone cheese, lettuce, tomato, onions, banana peppers, mayo and topped with Italian dressing” — has since dropped the “Carbone” and is now named the “Frankie,” the menu shows.

ScarFail via YouTube Sivero’s Frankie Carbone was found dead, frozen in a meat locker, after the Lufthansa heist.

Sivero’s “Goodfellas” character is famously found dead, frozen in a meat locker, after his involvement in the infamous Lufthansa heist at JFK in 1978.

“When they found Carbone in the meat truck, he was frozen so stiff it took them three days to thaw him out for the autopsy,” narrator Henry Hill says in the movie.

The 1990 film is based on the non-fiction book “Wiseguy” by Nicholas Pileggi.

Sivero also played Genco Abbandando in “The Godfather Part II.”

The kid probably showed no ill effects. Just like so many other kids who had mothers who smoked during pregnancy.
