Entertainment Bruce Jenner files request to dismiss to wrongful death lawsuit over Malibu car crash

    The adult stepchildren of the wealthy widow who died after Bruce Jenner rear-ended her car have no right to sue for wrongful death, the former Olympian argues in new court paperwork.

    The relatives weren't financially dependent on 69-year-old victim Kim Howe before her Feb. 7 death on the Pacific Coast Highway in Malibu and lacked standing when they sued Jenner May 1, the filing obtained by the Daily News states.

    "Bruce Jenner agrees with plaintiffs and their lawyers and all other affected persons that the automobile accident alleged in the complaint was a terrible tragedy," the filing states.

    But stepkids Dana Redmond, 60, and William Howe, 57, were not living with Howe when her Lexus was pushed by Jenner's Cadillac Escalade into the path of an oncoming Hummer — rather they were "independently working and living their own lives for decades in Maine and New York," the filing states.

    "They were well-off and successful and financially independent," according to Jenner's paperwork. "They did not depend on their elderly stepmother for food, clothing and shelter, or for any necessities of life."

    In their original lawsuit, the stepkids described themselves as having been dependent on Kim Howe and having "incurred bills and out-of-pocket damages and losses, to their great detriment."

    They said their stepmother's death caused damages including lost "love, affection, support, comfort, society, financial support and more."

    An online obituary for Howe said Redmond lived in Old Orchard Beach, Maine, and William Howe lived in West Seneca, N.Y.

    "Even after their father's death 10 years ago, Dana and William continued to have a close relationship with Ms. Howe," said their lawyer, Jeffrey Wolf.

    The stepkids asked for damages in excess of $25,000 to be proven at trial.

    They accused Jenner, 65, of speeding and having "violated the rules of the road" in the seconds leading up to the deadly chain-reaction.

    A law enforcement source who spoke to The News about the crash in April said Jenner was not over the speed limit but appeared to be driving too fast for traffic conditions.

    Jenner, who recently revealed that he is transgender, has not been charged in the ongoing investigation.

    At the time of the crash, police said they had trouble finding Howe's next of kin.

    Howe's death certificate also identified her friend, Lisa Ungar, as the one who claimed her and got her ashes.

    Nearly 17 million people watched Jenner's interview on April 24 with Diane Sawyer in which the gold medalist detailed how he has felt gender confusion since he was a child.

    Well, she has an estate, and the representative of that estate will have standing. Even better if she set up a trust naming those particular plaintiffs as beneficiaries, as they would then have standing through the trustee.

    And while no official charges have been filed against Brucie, what are the odds that he was texting when he plowed into this woman's vehicle?
