Cab jumps curb in NYC, plows into pedestrians near Rockefeller Center...

    NEW YORK (MYFOXNY) -A tourist reportedly lost a leg when a cab jumped a curb and smashed into her in Rockefeller Center on Tuesday morning.
    It happened at 49th and 6th Avenues at about 11:10 a.m.
    Sources tell MyFoxNY.com that a cabbie had gotten into a road rage argument with a livery cab driver and the cars were trying to out run each other.
    The cabbie apparently lost control and jumped the curb, hitting the woman who had been sitting on the fountain ledge.
    Apparently, Dr. Mehmet Oz, saw the scene from an office window and raced to the scene to help the seriously injured victim, who was visiting from England.
    A hot dog vendor reportedly helped pack her severed leg with ice to transport to the hospital.
    A bicyclist was also hit in the crash but only suffered minor injuries and was able to walk away.
    Police cordoned off the area as they investigated. A large crowd gathered to watch.

    This happens almost every day in NYC. . Heck, we get 150 people hit by subways every year. .. It's news cause Dr. Oz was there... (he must have had his publicist tweet it)

    As a former NYC paramedic, nothing worse than some Dr, who might be an internist, or show up with no equipment, no real emergency training, and try to run the show....

    No, in NYS, the good samaritan law covers non trained people (IIRC).

    It's ironic that British people reading about this will blame stupid Americans and the cab driver is probably from England via a former colony!

    think its the other way around: i haven't read it in awhile (a few years) but it used to say that as long as you assist within the limits of your training, you are covered. assuming he is an MD and not a therapist he is probably covered.

    NYS Public Health Law, Article 30 - Emergency Medical Services ;3000-a.
    "any person who voluntarily and without expectation of monetary compensation renders first aid or emergency treatment at the scene of an accident or other emergency outside a hospital, doctor's office or any other place having proper and necessary medical equipment, to a person who is unconscious, ill, or injured, shall not be liable for damages for injuries alleged to have been sustained by such person or for damages for the death of such person alleged to have occurred by reason of an act or omission in the rendering of such emergency treatment unless it is established that such injuries were or such death was caused by gross negligence on the part of such person. "

    The part that is confusing is where it says "Nothing in this section shall be deemed or construed to relieve a licensed physician, dentist, nurse, physical therapist or registered physician's assistant from liability for damages for injuries or death caused by an act or omission on the part of such person while rendering professional services in the normal and ordinary course of his or her practice." but that refers to a doctor, etc. not being immune from fucking up during the normal performance of his regular practice. As long as the doc was volunteering he is protected.

    i wonder though: if the doc ran down and took charge, then he might be liable. if however he ran down and put himself at the direction of the EMS (yeah, it could happen...) then he is protected.
