A Brooklyn man claims NYPD cops in a SUV passed through a stop sign and broadsided his vehicle — then allegedly fabricated charges that he was driving under the influence of alcohol.

“I think the whole thing was insane,” Oliver Wiggins, 31, told the Daily News. “They ran a stop sign and I think they were trying to hide that they caused the accident.”

Last week, a prosecutor moved to dismiss the case after the results of a blood test that Wiggins voluntarily took after the accident showed a blood alcohol content of zero and no trace of drugs.

“We believe this arrest was improper and solely motivated to cover up the actions of the police officers in failing to yield at a stop sign,” said lawyer Scott Rynecki.

Wiggins, 31, was driving on Glenwood Road about 1:30 a.m. when his Nissan Maxima was T-boned by a Police Department Ford SUV occupied by five cops at E. 43rd St. in East Flatbush. The SUV was pulling out of a dead-end street without flashing lights or a siren, according to Wiggins’ lawyer.

The accident report notes that there is no traffic control device at the location, but there actually is a stop sign for vehicles traveling on E. 43rd St.

Wiggins said the cops asked him if he had been drinking and he replied that earlier in the evening he had consumed a Malta — a nonalcoholic soft drink.

“Responding officers observed signs which indicate (Wiggins) may be intoxicated,” the accident report states.

Those signs, according to the criminal complaint, were red, watery eyes, slurred speech and the odor of an alcoholic beverage.

Is it common for five cops to ride in one car?

Cops always use the same set of lies. They do it because they know they can almost always get away with it.

Slurred speech, odor of something, acting strange, sudden movements, reaching for an object, watery eyes, etc, etc, etc.

I've read or heard read, 100's of DUI police reports--every single one say the exact same thing. No one has ever not been "unsteady on their feet"

They weren't banking on the guy coming up 100% clean --they nearly killed to guy, maybe his slurred speech was as the result of the accident
