Court: PA cops no longer need warrant to search vehicles

    Pennsylvania police officers no longer need a warrant to search a citizen’s vehicle, according to a recent state Supreme Court opinion.
    The high court’s opinion, released Tuesday, is being called a drastic change in citizens’ rights and police powers.

    Previously, citizens could refuse an officer’s request to search a vehicle. In most cases, the officer would then need a warrant — signed by a judge — to conduct the search.

    How does this not go to Supreme Court and get obliterated?

    The moron told the cops there was weed in the car. How the hell did this make it to the PA Supreme Court? Telling cops there is illegal shit in the car is probable cause for a warrantless search.

    According to sworn testimony by a Pennsylvania State Police spokesman, the following are indicators used to determine if a motorist might be a drug smuggler.

    Minorities: Motorist is a racial or ethnic minority.

    Deodorizers: In the car to mask odor of drugs.

    Windows: Blacked out.

    Color of Car: Car is blue, making it easier to blend in with traffic.

    Type of Car: A mid-size sedan with no frills, also to blend in with other cars.

    Mileage: High mileage on odometer.

    Maps: Unfolded maps, especially those opened to "source cities" like New York.

    Slow Driving: Person drives cautiously and below the speed limit to avoid detection.

    Phone, Radios: CB radio or cell phone in the vehicle.

    Luggage: Vehicle has either too much or too little luggage.

    Excuses: Driver asks to be excused to urinate (to use the opportunity to discard incriminating evidence).

    Fast Food: Bags in the car (couriers eat in their cars because they fear the cars or their drugs might be stolen)




    This list was from back in the 90's before terrorists became the bigger boogey man. Who needs a warrant with excuses like that?

    I had a burgandy Altima when I used to go pick up my own drugs, so it aint that far off.

    Reminds me of the post 9/11 FBI "He Might Be A Terrorist" list. One of the criteria was "If he keeps mentioning Constitutional rights."

    I read somewhere that if you see two minorities in the same car with out of state plates, it's a given there are drugs in the car.

    couldn't the cops always find some bullshit reason to search your car without a warrant anyway? the courts would side with cops if you tried to fight it.

    I read recently that if you have Colorado plates and you're in Wyoming or Nebraska or any state near CO you are going to get pulled over and searched for weed.

    There have been automobile exemptions to 4th Amendment protections almost since they have existed, it turns mostly on the definition of "exigent circumstances" which justify a warrant-less search.

    Also, if you get pulled over and they see you light up a cigarette, you're getting tested for driving under the influence automatically.
