    Sounds like a law school exam question: "Mr. X is legally drunk, driving down a dark street on a rainy night, a dark-skinned woman suddenly walks out in front of him, he hits her and she dies. He would have hit her whether or not he was drunk. She was warned not to go out into the street and was legally drunk. Explain his civil and criminal liability, and explain her assumption of risk." You can also throw in the fact she was obese, and that contributed to the inability to successfully treat her to make it even more difficult.

    That's fucked up and I'm not trying to blame the victim but I've seen pedestrians do really stupid shit. You should never assume someone sees you or you're good because you have the right of way etc. In my neighborhood growing up I noticed people making sharp turns without signaling, driving the wrong way down one-way streets, smoking/drinking behind the wheel, you name it. I would never turn my head away from oncoming traffic.

    The judge and prosecutor who teamed up in Brooklyn to let a former cop off with 90 days for a drunken driving death Friday tried to defend the indefensible by outrageously blaming the victim.
    Supreme Court Justice Allan Marrus and a representative of District Attorney Joe Hynes showed up for the sentencing of Andrew Kelly understanding that they had explaining to do.
    These quarters had accused them of all but decriminalizing drunken driving in Brooklyn by giving Kelly such a pass in the death of preacher's daughter Vionique Valnord. What they said made the flesh crawl.
    "She was at a wedding. She had been drinking," said Gayle Dampf, chief of the DA's Vehicular Crimes Bureau, also noting that Valnord walked out into the street, then "turned back" when she was hit by Kelly.
    Marrus chimed in with gross understatement, "The sentence may seem too light to some," before citing "the alcohol consumption of the victim, the fact that she walked out onto a rainy street to hail a cab against the advice of friends."
    In other words, in Brooklyn it's a petty crime to get smashed at a bar, pick up a "24 pack of beer" with a friend, run down and kill a woman who has a couple of drinks at a wedding celebration and changes direction after trying to hail a cab.
    She should have known better. Actually, she should have considered driving looped. How dare she walk under the influence?
    DWI laws are intended to insure that drivers are up to dealing with exactly the situation faced by Kelly: the unexpected on the road. The veering bike. The kid who runs from between cars. The lady who changes her mind and direction.
    Marrus and Hynes made a botch of this case, and the words spoken in court yesterday added insult to the loss of life.

    This makes me feel sick. I feel so bad for not only the woman, but her family. Having these things said about her just to cover some corrupt cop's ass. Just sad.

    *side note* I haven't the faintest idea how the FUCK to pronounce her name. :jj:

    this article is a little vague

    exactly how drunk was officer kelly?

    and also, what is the longest possible sentence he could have received? i would bet he would not spend more than a few years in the clink if punished to the fullest extent anyway.
