Operating Under the Influence... all encompassing: pot, prescription pills (prescribed or non-prescribed; per doctor's orders or recreational), huffing paint fumes or lighter fluid, and of course booze.

In Arizona, the statute reads "It is unlawful for a person to drive or be in actual physical control of a vehicle in this state under any of the following circumstances:1. While under the influence of intoxicating liquor, any drug, a vapor releasing substance containing a toxic substance or any combination of liquor, drugs or vapor releasing substances if the person is impaired to the slightest degree." A.R.S. sec. 28-1381(A)(1) (emphasis supplied).
Just about every state has the same, or a very similar, statute on the books (gotta get that federal transportation money!)
The funnest trials are the APC cases (actual physical control) or the DUI with prescription drugs. The last Trial I did was a Not Guilty on a DUI prescription drugs with a little old lady that plowed into a mailbox!
