    Anyone know if Howard has filed his appeal yet. I know these things take time - attorneys need time to figure out their bullshit. Curious.

    ...howard is probably a little tired of paying lawyers after losing the first go round. it costs money to file an appeal, corporate lawyers arent cheap and rule of thumb is unless the judge made a blatant legal or prejudicial error, the judges colleagues arent going to rule against her. if he is getting any good advise hes probably been told to think about saving his money and moving on

    i bet he doesn't file: if AGT is as popular as he hopes it is, he will use it as a club during his next contract negotiation with Sirius to get more than they owe him. if NBC likes him again, he can always put a syndicated show on their cable network instead of on Sirius.

    I thought he did file. I remember thinking that he'd just ignore it, only to be surprised by him actually taking action and doing something... Believe he actually filed something.

    The Examiner2012-04-27: Howard Stern's production company One Twelve and his agent Don Buchwald have officially filed an appeal in their lawsuit against Sirius XM. Earlier this month, New York Supreme Court Judge Barbara Kapnick threw out Stern's lawsuit claiming he was owed $300 million in unpaid stock bonuses that he should have received after the Sirius XM 2008 merger. Stern's contract promised him stock bonuses based on the number of subscribers that Sirius gained during his tenure. The debate comes down to whether the eight million XM subscribers brought in by the merger should be counted toward's Stern's bonuses. Stern's appeal.

    Does anyone know the number of subscribers his contract required him to bring in to fulfill his contract? I'm curious to know the degree of his failure.

    Even a successful appeal would only get him to court, where he could then lose. Or, if he wins, he would spend more years in court as Sirius appeals.

    Way to enjoy those golden years, eh?

    His contract just included counts of new subscribers during yearly segments. It was something like each 2 million subs in a one year period was an extra $75 million. He hit ONE of these when he first started out, and everyone agrees it was paid.

    When the merger happened, Howard tried to say that he hit FOUR of the 2 million subscription bonuses all at once due to the influx of XM subscribers now being part of the company. He wanted to sue for like $300 million, or, 4 of his $75 million bonuses based on 4 x 2 million subscriptions coming in that year. It's fucking ridiculous. It's literally just trying to exploit a "loophole" in his contract. BTW, his contract already had something in it in the event of a merger. He was paid a $25 million bonus when the companies merged.
