Attorney Anna Levine explained to Judge John Payne that her client was sitting in the courthouse lockup but was not brought into the courtroom because of his wardrobe malfunction, MassLive.com reported. The website says Dermont E. Weaver Jr., 31, of Springfield, was supposed to be arraigned for five counts of open and gross lewdness after allegedly exposing himself to a family around 5:30 p.m. Saturday. Citing a police report, MassLive said the father claimed he screamed at Weaver to pull his pants up and tried to block his daughters' view. Weaver allegedly tried to run when police arrived but was arrested within minutes. At the time, he was wearing a gray hooded sweatshirt, running shoes and no pants. While Weaver's arraignment never did occur Monday, the judge did order a mental health evaluation after it was requested by the defense attorney.
