    The homeowner might be in trouble for shooting at the fleeing suspect in the car and killing him but I imagine things are a bit different in Texas. If that happened in Chicago the homeowner would be sitting in jail right now and all of the black activists(if the perps were black) would be protesting outside the guys home.

    You can't kill someone (legally, as in justifiable homicide) based upon perceived, future danger.

    The threat has to be imminent.
