    They killed the wrong man.

    There were two Daniel Otts living in northeast Ohio in 2006 — one a 69-year-old career car thief on federal parole, the other a law-abiding, talented greenhouse worker adored by his family.

    And two Logan County brothers wanted the former one dead. But, prosecutors now say, the hit man they hired killed the latter in a case of mistaken identity instead.

    The trio almost got away with it.

    Geauga County prosecutors this afternoon announced the indictment of Joe Rosebrook, 59; his brother, Jeff Rosebrook, 57; and 45-year-old Chad South, of Montgomery County in the May 26, 2006, murder of 31-year-old Daniel Ott in Geauga County’s Burton Township.

    All are charged with multiple counts including conspiracy to commit aggravated murder; aggravated murder with several specifications, including that it was in retaliation or for the intimidation of a witness in a criminal case; and kidnapping.

    Prosecutors said Joe Rosebook ordered the hit from inside a prison cell, Jeff Rosebook acted as his intermediary and South was the triggerman. All three were arrested a week ago and held on preliminary charges that were sealed by the court until a grand jury could consider the more serious charges announced today.

    Ott was shot inside his home in the township, south of Chardon, before dawn that morning. He and his girlfriend were asleep when they were awakened by their barking dog, and then an intruder burst in.

    Authorities say South, wearing a ski mask and camouflaged-clothing, bound Ott’s hands with duct tape and, following a scuffle, shot him in the chest.

    “Joe Rosebrook blamed Daniel Ott, the car thief, for his downfall and prison sentence in the first place,” said Geauga County Prosecutor James Flaiz. “He felt he’d been double-crossed.”

    Authorities had said from the beginning that there was nothing to indicate why Daniel Ott, the family man, would have been targeted for an execution-style. His girlfriend wasn’t hurt.

    The Rosebrook family is well-known in Union and Logan counties and the brothers have long been considered hard-working laborers in mostly blue-collar jobs. Jeff Rosebrook is a longtime Perry Township trustee in Logan County who runs his own business, and the other two township trustees say he was well respected and personable.

    Law-enforcement officers, however, suspected Joe Rosebrook of crimes ranging from petty thefts and arsons to burglarizing houses and stealing from farms.

    For more than 20 years, he ran what national vehicle-theft and insurance-fraud experts have said was one of the most prolific and well-organized chop-shop operations in the country. Every time the cops got close to him, something terrible happened to their star witnesses: one went missing 1999, another was critically injured in a car bombing.

    Rosebrook is officially listed as the suspect in those unsolved case files, but no serious criminal charges against him ever stuck.

    His luck changed in 2004, when Logan County detectives raided his sprawling $384,000, 75-acre property. They turned up several expensive stolen vehicles, and Joe Rosebrook was charged with running a criminal enterprise and other crimes.

    While on house arrest and awaiting trial in that case, Joe Rosebrook hired Daniel Ott, the car thief who lived in Akron then, to kill a man was cooperating with authorities on the chop-shop charges.

    Case files at the Logan County sheriff’s office show that Ott was paid $2,000 and given an address and a photograph of the witness he was to kill. Joe Rosebrook promised him $13,000 more once the deed was done. In recorded phone conversations, Rosebook called the hit “a remodel” and when Ott said he would drive the witness to Columbus and kill him in the car, Rosebrook replied, “ It doesn’t matter. I’d like to see him gone.”

    But Ott didn’t kill the witness. He went to sheriff’s detectives instead. Rosebrook’ was indicted on conspiracy to commit aggravated murder, a first-degree felony and in 2005, he was sentenced to 10 years in prison.

    Rosebrook had shared a county jail cell with South while awaiting trial back then, and also knew him in prison. Flaiz said “That’s how this plan was hatched.”

    So from inside his prison cell, authorities now say, Joe Rosebrook told his brother that he wanted the car thief, Daniel Ott, dead and directed him to get in touch with South. Jeff Rosebrook did so, detectives said.

    Flaiz said South was given good information about the car-thief Daniel Ott. “But he lost it. So we believe he went looking for information on his own, and that’s how, somehow, he made it to the wrong Daniel Ott.”

    In the decade since, Flaiz said, there have been two attempts on the car-thief Daniel Ott’s life. This case isn’t over with these indictments; he expects more.

    Joe Rosebrook was released from prison in 2004. He had since moved to Florida, and was arrested there by federal marshals last week. Jeff Rosebrook was arrested at his home in Logan County, and South was picked up in Moraine in Montgomery County, where he lived.

    Flaiz said this case is important for Daniel Ott and his family but also for the justice system.

    “Nothing frustrates and strikes at the heart of the justice system more than the intimidation of and murder of witnesses,” he said. “To finally provide Daniel Ott’s family some answers — as awful as they may be — about how and why this happened to the man they loved is incredibly important to us all.”

    At last, justice for Nicky.

    The city will pay $5 million to the elderly mother of Nicholas Guido, an innocent victim slain on Christmas Day 1986 by hit men acting on bogus information from Mafia Cops Louis Eppolito and Stephen Caracappa, the Daily News has learned.

    The payout exceeds the monetary compensation usually dispensed to victims of wrongful death at the hands of cops, but is justified by the extraordinary circumstances surrounding the mistaken identity rubout, said lawyer Mark Longo.

    The traitorous Eppolito and Caracappa had passed the name “Nicholas Guido” to then
    -Luchese underboss Anthony (Gaspipe) Casso who was seeking retribution against the shooters who tried and failed to whack him.

    The detectives were on Casso’s payroll acting as his “crystal ball” for confidential police information, but the gangster refused to pay extra for Guido’s home address. Instead, Casso reached out to a source at the Brooklyn Union Gas company and obtained the address for the wrong Nicholas Guido, according to testimony from the Mafia Cops trial.

    Small world... I actually work with a family member of the surviving Ott. He actually just heard about all this for the first time a week or so ago. He said it's strange to get family updates from the local news.
