I'm Going to Sue You!

    So I have this deadbeat client that owes me $10k. Not a huge deal of money, but it's now the principle of the matter at this point. It's been almost 120 days and they keep promising to pay, but so far, all I've gotten is a check for $1,000.00 after I threatened to turn them over to my lawyers. So I'm going to let my lawyer deal with it now.

    Anyone ever experience this? Had to use Small Claims Court or Collections? What are my other options? How best to get deadbeat clients to pay? I'm in the state of California, if that matters.

    Howard related because Howard sues everyone!

    Slap a mechanic's lien on their house. It will drive them crazy, impede their ability to sell or borrow on it, and might fuck up their credit rating.

    I'm not a mechanic and they don't own a house as far as I know. They might own a condo. How does that work?

    I tend to call a coupla hard, pipe-hittin' people of color, who'll go to work on the homes here with a pair of pliers and a blow torch.

    Can you give us a very general idea of the services you provide?

    I ask only because your ability to collect will be largely contingent upon your ability to demonstrate that the money is actually owed.

    I work in movies/advertising/commercials that sorta thing. I have a defacto contract in the form of an email, they accepted the work and we delivered the files. Now, 120 days later, they are saying they didn't get paid by the end client. That's not really my problem. I paid my subcontractors, now they need to pay me! They paid me $1k "out of their own pocket" but still owe me $9k.

    ...small claims is only good for 5 grand. you can get a judgement but depending on the size of the douche bag collecting the money is another thing. your lawyer will know what to do including turning his name into the credit reporting agencies. you might be able to sell the debt to a collector for 0.XX on a dollar and if the guy ever pops up looking for credit he will still end up paying.

    Yeah, that's my last resort. I've heard getting a judgement is easy, but collecting can be a bitch!

    Can't squeeze blood from a turnip.
    If they don't have the money, likely you will struggle getting it.

    At least with a judgement, you can move forward to liens/garnishments?


    .....and maybe next time get a healthy deposit before doing the work, or run a credit check. :dontknow:

    I usually get 50% upfront with new clients, but since this was such a small amount, I didn't! :bigcry:

    I threatened to sue a contractor over some shitty plumbing instalation for the bathroom in my basement. It was around 4 k of damage. We settled at around 3. I still reported them to consumer protection and the BBB.
