He'll need a good attorney to keep it out. He will NOT plead out to any felony because he of his obsession with guns, and his ability to legally possess guns is in jeopardy. Unless he's offered a deal to plead only to misdemeanors, he's going to trial for sure.
And? He's looking for a misplaced firearm that has NOTHING to do with the case.
Actually, the video will HELP him. There's no sign of violence, anger, aggression, even being under stress looking for his lost firearm. There isn't a single second of him even being near her on this video, outside of the OBVIOUS fake slap shit she does. He's in the fucking kitchen when does this, you hear him asking her something literally a second later from 30 feet away. She's also helping him, he shows no indication that he is aware that she is setting him up, because in reality, he didn't do anything. He's worried about the misplaced firearm when the police arrive, not a domestic situation.
My theory? Play fighting that got out of hand, she's one of those crazy bitches with daddy issues.
This will get tossed. He's got cameras all over the house. He knows this. This is a setup and nothing else.
You can never know how a criminal case will proceed or turn out. For one, you have to take into account the actions of the police. They don't look good. It's an embarrassment to that police department because of the way the officers handled a domestic call. The court is going to feel pressure to do SOMETHING. Also, there's the fairly high profile of Anthony Cumia. This isn't just some anonymous schmuck. Having said all of that however, my guess is that Dani will ultimately refuse to cooperate (because a prosecutor can still bring a complaint on her behalf, whether she wants it or not) and the case will be dismissed. Another possibility is Cumia pleading out to one or more misdemeanors. But like I mentioned before, if a prosecutor, for whatever reason, INSISTS on charging Cumia with a felony, he WILL take the case to a trial because he does not want to lose his ability to own firearms. Guns are his life and his passion. This is why he checked into the "rehab". He is doing whatever he can beforehand to persuade the court to forego a felony charge.
