    State court declines to halt bloody chicken-slaughter ritual by Orthodox Jews

    A state judge in Manhattan on Monday refused to block Orthodox Jewish congregations in Brooklyn from carrying out the bloody Kaporos chicken-slaughter ritual on public streets in advance of Yom Kippur.

    Residents and animal-welfare activist groups had sued, claiming the ritual -- an atonement ceremony in which believers swing the chickens by their wings and slit their throats -- subjected them to both a grisly display of screaming birds and a public health hazard.

    Supreme Court Judge Debra James, dodging the claimed conflict between religious rights and public health, ruled that city officials had discretion to decide whether to enforce sanitary codes, and private parties couldn't sue over an alleged "public nuisance."

    Lawyer Nora Constance Marino, who brought the suit, said that although she respected the ruling, "I feel terrible for my clients who are going to be forced to endure this bloodbath for another year and . . . deal with sights, sounds, smells, blood and toxins that could lead to a major public health threat."

    Nick Paolucci, a spokesman for the city law department, said, "We are pleased that the court recognized the city's authority to exercise discretion in this matter."

    The landmark decision by the Supreme Court of the United States in the case of the Church of Lukumi Babalu Aye v. City of Hialeah in 1993 upheld the right of Santería adherents to practice ritual animal sacrifice in the United States of America. Likewise in Texas in 2009, legal and religious issues that related to animal sacrifice, animal rights and freedom of religion were taken to the 5th U.S. Circuit Court of Appeals in the case of Jose Merced, President Templo Yoruba Omo Orisha Texas, Inc., v. City of Euless. The court ruling that the Merced case of the freedom of exercise of religion was meritorious and prevailing and that Merced was entitled under the Texas Religious Freedom and Restoration Act (TRFRA) to an injunction preventing the city of Euless, Texas from enforcing its ordinances that burdened his religious practices relating to the use of animals,[47] (see Tex. Civ. Prac. & Rem. Code § 110.005(a)(2)

    I don't have a problem with animal sacrifice. I don't understand why it has to take place in a public area. You want to sacrifice an animal for religious purposes, just do it in your own home or place of worship, not my home or a public place.

    Animal rights activists fight Jewish chicken slaughter ritual on streets of Brooklyn

    Feathers — and fingers — were flying in Brooklyn Thursday as animal rights activists objected openly to the conservative Jewish community tradition of atoning for sins and donating money to local synagogues by buying chickens and having them slaughtered on the spot.

    Rina Deych, a local activist, said she and a friend, Vanessa Dawson, were on the streets of Borough Park trying to persuade people that they could follow Jewish law by donating money instead of killing chickens when one young man flipped the bird.

    “(Another) man tried to put a poor, tortured chicken on my head and two others cursed at me,” she said in an email to the Daily News.

    She sent a photo of one unidentified man giving her the middle finger and said it was “a disturbing example of what is being taught to these innocent children. Feces and feathers were everywhere on a public sidewalk and the stench was overpowering.”

    Deych was part of a group of animal rights activists and area residents who went to court last month to try to stop the increasingly popular tradition, which has become a major fundraising activity in Brooklyn’s conservative Jewish community.

    Their Kaporos tradition involves families buying multiple chickens at inflated prices. The money goes to the synagogue. The chickens — 50,000 of them — are given to unlicensed “butchers” who swing the birds over their own heads three times and then chop off the chickens' heads. The dead chickens are given to the poor.

    The belief is that by swinging the bird, the sins of the person go into the bird and then the death of the bird atones for those sins.

    Kaporos occurs in the days leading up to Yom Kippur, which is the annual day of atonement in the Jewish faith. Yom Kippur starts Tuesday.

    Although more liberal Jews contend that giving money instead of slaughtering expensive chickens is also acceptable, the Brooklyn communities say this is an important tradition from the old country and they came here for the freedom to practice as they wished.

    Earlier this week, Manhattan Supreme Court Justice Debra James rejected a request by Deych and her neighbors to block the practice and order the city to enforce its health and sanitation laws.

    They had argued that the Kaporas activities have become so expansive that they take up vast swaths of sidewalks and public streets and create a huge public nuisance and health hazard.

    The judge agreed with city lawyers that the city has the right to exercise its discretion about what laws it wants to enforce. She said only one law is mandatory: The cops must give a ticket or arrest someone violating the agriculture and markets law that outlaws unlicensed slaughterhouses.

    James said there was no evidence that anyone had ever tried to file a complaint with the NYPD about that or that the police department refused to accept such a complaint.

    Meanwhile, Deych said, the slaughter continues.

    "Behind a curtain blowing in the wind, we could see chickens being dismembered. A man wearing a bloody white apron intentionally stomped on an unlucky bird who fell to the ground while trying to get away,” she said.

    She insisted that most of the birds — which are very young — never reach the tables of the poor but are thrown away.
