Judge Kapnick -- reversed on appeal only twice in the last five years

I did some more research on Judge Kapnick. As far as I can tell, in cases where she granted summary judgment, she has only been reversed twice in the last five years on appeal. Once in 2009 and once in 2007. Howard is getting some misinformation from his overzealous lawyers. His analysis is way off so I wonder what they are telling him. Juries do not get to interpret contracts, it's a question of law for a Judge. Also, unless the contract is ambiguous, none of this external evidence that he is talking about is going to be allowed into evidence. The appeals court is only going to look at the contract, nothing else. So it doesn't matter what Howard and his team of greedy idiots thinks the contract meant. If it wasn't in the contract, the court isn't going to know about it.

 

She also wants Howard's pants. Just like the old days in high school with the Polacks, you flim flam Jew bastard.

 

I guess twice in 5 years is alot...

 

When is Howard going to realize that the fucking Internet isn't just for rich assholes with homes in the Hamptons? His half-truths aren't going to be unchecked like they were in the mid-nineties.

 

What Howard says on the show and what his lawyers tell him are two different things...Haven't you learned that by now????

he is grossly misinformed about the legal process

he claimed judges sign sj motions 'at the end of the day' with little thought -- they may deny sj like that, bit they do not grant it like that -- particularly in a high profile case

he also falsely claimed judges grant sj versus plaintiffs routinely -- the exact opposite is true

i would love to know how much he has squandered on lawyers

the only snowball's chance in hell he has is if his attorneys are able to find a similar contract in another state/jurisdiction where the judge's ruling was contradictory or if a case upon which the judge's decision was made was improperly applied, etc.

But usually, judges have clerks (not dummies who help bag your groceries) who research all the relevant case law and avoid these problems, but once in awhile...

Like I said, it's probably pretty grim, considering this judge's record. Two reversals in 5 years (who knows how many matters have been adjudicated before her) is not very good odds.

You are talking about a guy who thinks working 4 hours a day, two day a week is a full work week.

 

At some point someone needs to sit down and be honest with howard.

I doubt anyone has the balls to do just that though.
