    Toxicology reports revealed Kevin Ward Jr., was under the influence of marijuana on the night he was struck and killed by a sprint car driven by Tony Stewart, Ontario County (N.Y.) District Attorney Michael Tantillo said Wednesday.

    At a news conference to announce that a grand jury had declined to indict Stewart in Ward's death, Tantillo said the level of marijuana in Ward's system was high enough to impair judgment.

    First and foremost, the Ward kid, high or not, was a dumbass. That being said, there's been a huge debate about what constitutes 'being under the influence' of pot. Drug testing is a huge issue for a lot of people, because a casual smoker who hit a joint a few times at a party two weekends ago can still be classified as 'impaired' by virtue of a random drug test. This article (disclaimer: it's a pro weed source) gets to the meat of the matter pretty succinctly.

While the Colorado Legislature debated a per se THC limit of five ng/ml, Denver News’ medical marijuana reviewer (and medical marijuana patient), William Breathes, subjected himself to blood draws to test his THC levels. After a 15-hour period of abstinence, Mr. Breathes’ THC levels were still 13.5 ng/ml. According to his physician, Mr. Breathes was in “no way incapacitated” at the time.6 This first-person account demonstrates the very real possibility that medical marijuana patients and other heavy marijuana users could face criminal charges under a per se system even if they are not actually impaired."

    According to some reports, Ward may have grabbed or jumped onto Stewart's car. If so, the excess weight would have caused the car to veer. The Grand Jury interviewed over a dozen people and reviewed multiple videos (some of which have not been released to the public), showing different angles of the altercation. If Steward intentionally turned or accelerated into Ward, the Grand Jury would have possibly decided a different conclusion. It isn't a "fact", it is your opinion. Big difference.

    No, it just means I'm sick and tired of the weed 'activists' claiming that weed is the best thing since sliced bread and rolled toilet paper
    by citing the most specious of 'scientific' sources and refusing to acknowledge the body of science that has actually PROVEN things
    about the drug and it's use via the scientific method and peer review.
