Legal experts, I need your help with AA/Expedia

    The long and the short of it is this:

    My wife and I: Canadians living in Korea.
    The problem: My wife's Canadian credit card was double charged by Expedia (Expedia says American Airlines was responsible, but the fuckup occurred via an Expedia website error, which they've admitted to on tape) for an airline ticket last May. The credit card company has a 3 month period whereupon they could just annul the transfer, but we never bothered, as Expedia promised the funds would have been refunded within 3/4 billing cycles. So now Visa can't help.

    The bigger problem: after countless hours on the phone (a lot of it at my expense) and a lot of hooey from both ends, we have proof that no refund has been given, long after it's been promised to us by both companies (may 29th), but we can't sue in small claims court in Korea.

    I don't care who's at fault here, I just want my fucking money. Hiring a lawyer is cost-prohibitive and I've no idea where to start with this shit. Any company with balls would have owned up and just refunded the difference immediately.

    South, obviously. I'd be typing this from the gulag, otherwise. Or the N. Korean equivalent.

    The excuse given to me (via AA to Expedia) is that one portion of the flight was through Westjet (a Canadian airline), and AA is waiting for the refund from them before they refund us the entire balance. It's tantamount to corporate theft in my eyes, and sounds like complete horseshit. AA has no refund dept. contact number.

    I need to know exactly who to take to court, otherwise I'm wasting even more time and effort, and I've pulled out every hair in my head this past year. It's just over $2000.

    It works must faster in S. Korea than you think, dude. I'm way ahead of you. All that was done the week after the discrepancy was noted (the week after I made the purchase). If a company tells you the refund is being processed, and the website indicates that a refund request "has been submitted", you think everything is on the up and up, and you DON'T call the credit card company. If I thought they were full of shit, I would have called them immediately.

    Waiting is the worst thing in the world. Never wait. Even if a company promises something. You explore every avenue for a refund (disputing the charge first), assuming the company won't make good.

    The S. Korea problem is one of jurisdiction.

    How much dough are we talking?

    i'd probably file a local small claims action for the cost of the ticket, serve both AA and Expedia by certified mail, and see if they have any executives that want to spend the day with you in small claims court :coffee:

    Your beef is with Expedia, not aa... You gave your credit card to only Expedia. If they point the finger at aa, tell them to pound sand.

    who do you sue? In this case, you sue them both in the same lawsuit and let the judge decide who pays.

    Those companies like expedia suck. I have had much much more luck dealing directly with the airlines.

    Btw, contact the Canadian or us embassy in Korea and ask for the agent of service for both Expedia and aa in Korea, those are the people that you serve papers to...
