WTF Legal help please.

    I found out the owner of the automotive shop I work at is selling the place. Does he legally have to inform his employees? If the new owners don't keep the same operations going, do they have to give us two weeks notice before letting us go? If they keep things going, can they replace the current employees at their whim? Can they try to reduce our pay?

    I hate this shit. I haven't even been here a year. I found out through a customer who read in the local paper that the shop was sold.

    Please don't make a mockery of this.

    I'm not a lawyer but I don't think I would have any legal obligation to tell my employees if I sold the business. I would simply because I'd give them first chance to buy it.

    I've been through this in california and no, they dont owe you anything but you'll be able to collect unemployment at least. I suggest working your ass off, having a good attitude and hope for the best, at the very least you'll still have a good reference

    The problem with asking for legal advice on a message board (and I say this with peace and love) is that you have no way of knowing if the advice you are getting is accurate to your situation. Putting aside trolls and people who think they know the law because of something they "heard" from a drinking buddy (we call that Tavern Law where I practice), the laws of each state vary. As such, someone could (in good faith) give you perfectly accurate advice for their jurisdiction and it is wholly inapplicable to the state where you reside. There's also the fact that there may be facts involved that you haven't reported that could affect the outcome of the decision.

    Therefore, the best bit of advice I can give you to contact a competent attorney in your own location or, if you don't think you can afford an attorney, possibly your state's labor department hotline (if there is one).

    Second:

    The existing owners don't owe you anything as far as notification. With the sale of the business goes all the liabilities. Those will be transferred to the new owners that must honor them (pensions, etc).

    The new owners can do whatever they like with respect to staff.

    Look around to see if there is a workers center or an employment law clinic inyour area. They might know the answer to your question.
