Listeners had to be connected through him, example promotion. He doesn't get credit for xm subscribers. Example if you own a chevrolet, it has xm radio.

If XM merged with Sirius, Howie was paid X amount as a bonus. That was to be his sole bonus in the event of a merger. Howie stopped getting Sirius stock bonuses after 2007 because Sirius' subscribers were decreasing and not increasing far and above internal estimates. So Howie and Don didn't sue for two years because they were afraid if they didn't Sirius would go bankrupt . After signing a new deal for less marbles than Howie wanted, he decided to sue Sirius/XM.... because he was getting those marbles some way or another. He wanted the marbles he was hoping to get in 2008-10 from stock bonuses and the marbles to make up for the new deal that was for less than he wanted. That's it in a nutshell.
Check the smoking gun, Howie has a history of frivolous lawsuits.

Howard's lawsuit pertains to "the total number of Sirius subscribers" language of the contract, not the "HS-generated subscribers" language. Under the total number of subscribers language, listeners do not have to be connected to him.
