    And yet, if paternity is determined, it doesn't automatically absolve the guy who is/was acting as the parent from child support.

    The courts don't look at paternity alone when determining responsibility for a child.

    I guess my point is, if the woman lied to the man about paternity, but he's been acting as the child's parent, then no court is going to absolve him of that responsibility.

    It's not fair to the kid. If you love the kid as your own and you've been supporting the child, how much would you have to hate the woman to take it out on the kid?

    Sure, dump her, but don't shit on the kid.

    I don't know what you mean. Do you mean that a guy should stop paying or are you asking?

    Either way, if you're supporting the child, you need to wait until a family court judge adjudicates the matter. If your intention is to leave the relationship, you are, of course, free to do so, but you're not necessarily free to leave your obligations to that child, paternity or not.

    But what jury would deny someone who's defense is that everytime he looks at the kid all he see's is the ex-wife's betrayal? I bet he could get jury sympathy with a psychological defense based upon that.

    I wonder if he could turn that into a palimony suit against the wife and biological father for emotional suffering?

    The court will, of course, acknowledge that you've been deceived, but so has the child.

    The best interests of the child is always the barometer.

    I'm sure most guys just split town and fuck over the kid though.

    I would offer a deal: I get sole and absolute custody in exchange, to "protect" the kid from her influence. Then the ho would never see the kid again. The satisfaction from that would offset the feelings of betrayal, and then we would relocate across the country.

    True about the legal system, and true in spirit, about the kid. But it means "Daddy" is getting cluster-fucked...he got cheated on, deceived into a false relationship with the bastard offspring, and now he has to support another man's kid, whether he wants to or not. Depending on the state, I think he could also be forced to pay alimony to the "woman" who is responsible for the whole mess, and BTW, she'll still probably still get primary custody of the kid. If "Daddy" went berserk and killed everyone, it would be a haaaarrible thing, but an understandable thing... Oh yeah, meanwhile, biological Daddy is still out "spreading his seed", and keeping all his money....

    If the child isn't biologically the offspring of the father's he should set the terms of support. Let the mother pursue the biological father on her own time/dime.

    I have no sympathy for people who conceive children in an unstable relationship.

    I think I would feel guilty about leaving the kid to be raised by an unstable woman. Since the family courts would probably not side with me, I would investigate a breach of contract suit in the civil courts, where the child's welfare would not be an issue and her's and the bf's future assets would be attachable.
