IMO: If a bank makes a mistake like that, then fuck them. THEY should be the ones who pay the money back.

It doesn't work like that. If an organization makes a mistake, they have the right to fix it. If they left it in his account for a year or so, fine, but this was a matter of days.

I would just buy a bunch of shit on Amazon and tell them I never looked at my balance. I would not spend all the money. Just a a few thousand. Honest mistake!

exactly! there was a case in the news 2 weeks ago. they have been paying this man in new york his pension. he worked for the rail road. he just passed away a year ago and now the wife has been continuing to receive benefits which is appropriate. the thing is the insurance company admitted recently, they goofed. for the last 20 years they have been awarding the man extra money each month by accident. it's over 100k total if i remember AND THEY WANT IT BACK!!!!!!!! the fucking woman is in her 80's and they threatened to put a lean on her house etc.. what monsters.

They are liable. I suspect, however, that there is much more to the story.

Deposits are not made by saying your name and handing over a check. The account number has to be keyed in. Then checked for the name. The odds of a typo on the number resulting in a name that is identical is nil.

The teller was in on it. Claim a mistake, get fired, split the money with the 18 y/o, which is as much as the teller would clear after taxes in a year.

Im no soap box for Banks. I think most bankers are scum bags. But the laws the law. They.can pursue this kid in criminal.court and or legal court if they wished. For the sake of not ruining his life.he should return the money. Im sure they already fired the poor clerk that made the fuck up.

If he was 17 it might be a different story, but since he's 18 it'll probably just fuck up his life. On the other hand, the way he blows money maybe he was already fucked.

Indeed. Some mad scientist invented the "Deposit Slip" many years ago. An account number is part of the process of a bank taking your money.

Jail shouldn't be an option and the cops shouldn't be involved. The bank should sue the kid, not draw on public resources to get back money they have away. Just my .02.
