The so-called "cannibal cop" was found guilty two years ago of conspiring to kidnap, kill and cook a list of woman he maintained online, including his wife. However, Valle never acted on any of the plans investigators found through his digital correspondence. Wife says NYC 'cannibal cop' viewed disturbing pornography The estranged wife of Gilberto Valle struggled to keep her composure as she testified about discovering shocking emails and other evidence on his computer showing he had discussed killing her and abducting, torturing and eating other women. In July of 2014, Valle's conviction was overturned. Federal Judge Paul Gardephe ruled there was insufficient evidence to support Valle's conviction, and subsequently wrote "it is more likely than not the case that all of Valle's Internet communications about kidnapping are fantasy role-play." The federal appeal court upheld the lower court's decision Thursday in a 2-1 vote, according to the NY Post. "Fantasizing about committing a crime ... is not a crime," Judge Barrington Parkerwriting for the majority, according to Reuters.
