    PRETORIA, SOUTH AFRICA—Oscar Pistorius should not go to jail because he could be gang raped and cannot easily take a shower, said a defence witness Tuesday at the Paralympic gold medallist's sentencing hearing.

    Probation officer and defence witness Annette Vergeer said Pistorius should not serve time behind bars after fatally shooting his model girlfriend as he is more vulnerable than an able bodied person, supporting a key component of the defence strategy to keep Pistorius from behind bars.

    “I've recently done a case for rape within the prison, gang rape. How can we say that he won't be exposed to that?” said Vergeer, who earlier admitted that she was being paid by the Pistorius defence team to testify on behalf of the athlete.

    “He might be exposed to those circumstances and without legs he will be vulnerable and a lot more vulnerable than the normal man,” said Vergeer, a woman who commanded attention in court with her two-toned, black-and-white hairstyle worn in a crown of asymmetrical spikes. “How do you shower my lady without the legs?” said Vergeer, “how do you wash yourself?”

    In September, Judge Thokozile Masipa ruled that the 27-year-old star sprinter is guilty of culpable homicide after shooting Reeva Steenkamp four times through a locked toilet door, a shock verdict to South Africans who questioned if the country’s judicial system is too soft on crime.

    There is no minimum punishment for culpable homicide, with the sentence at the judge’s discretion. The severity of the sentence could range from 15 years behind bars to correctional supervision — house arrest — which would see the double-amputee avoid jail time altogether.

    Oscar Pistorius was portrayed as a "poor victim" Tuesday ahead of his sentencing for killing girlfriend Reeva Steenkamp.

    As a first-time offender, a person who needs specialized psychiatric and physical care and as someone who has contributed extensively to South African society, Pistorius is an ideal candidate for a non-custodial sentence, say legal analysts. “The evidence points quite compellingly towards a non-custodial sentence,” said Martin Hood, a criminal lawyer based in Johannesburg.

    Earlier, Vergeer recommended that jail time in South Africa’s notoriously brutal and overcrowded prisons is an “excessive” punishment for Pistorius. “The accused’s sentence began on the day he shot the deceased,” said Vergeer, who recommended Pistorius be placed under house arrest for the duration of his sentence and work with disabled children.

    “He would sacrifice everything to have Ms. Steenkamp back alive,” said Vergeer, who testified that Pistorius is paying monthly installments to Steenkamp's parents.

    But in his blistering cross-examination, state prosecutor Gerrie Nel cast doubt on Vergeer's account, saying that though the Steenkamps have received $600 from Pistorius a month, they intend to pay it all back. Nel said that the Steenkamps also turned down a lump sum of $37,500 from Pistorius, money he made from selling a car. “The deceased's mother went so far to say that she rejects that and that she doesn't want blood money,” said Nel.

    As Nel grilled Vergeer, Pistorius scribbled in his notepad and passed pieces of paper to his defence team.

    A lawyer representing Reeva's parents, Dup de Bruyn, said the Steenkamps approached Pistorius for money after their daughter was shot. Pistorius agreed to provide about $600 a month to Barry and June Steenkamp, with the condition that they keep the deal private.

    The Steenkamps, who received the money for 18 months, are now in a position to repay Pistorius, said De Bruyn. The lawyer said that the Steenkamps are not pursuing a civil case. “Mr. and Mrs. Steenkamp do not want any money,” he said, “there will be no civil case, they want closure and for this to be over.”

    Pistorius shot Steenkamp four times with “Black Talon” hollow-point bullets early Valentine’s Day morning in 2013. Judge Masipa ruled he was not guilty on any charge of murder, saying Pistorius could not have known he would kill someone when he fired four shots into the toilet door. “It could not be said that he foresaw that either the deceased or anybody else for that matter might be killed when he fired the shots at the toilet door,” said Judge Masipa in her judgment.

    Prosecutors disagree with her interpretation of murder and have said that if Pistorius receives a soft sentence they may appeal her decision. Nel has indicated he will call a minimum of two witnesses to testify that Pistorius should serve a stiffer sentence.

    Judge Masipa is expected to hand down her sentence on Friday, a prosecution source told the Toronto Star. The state and defence then have 14 days to make an application to appeal.

    The sentencing hearing continues Wednesday.

    Pretty amazing how many people they can find willing to testify that a guy who shoots a woman to death shouldn't go to prison for even a day.

    You could say that about any convict that he could be ganged raped in prison. Why bother to sentence anybody.
