Is he going to have to put his talons on the bible and swear?
...doubt it since he cant be cross examined but, what the bird says and he says it in the voice of the victim, that could be admitted into evidence and the jury can take it or leave it as to its value. big maybe but it will be interesting to see what happens.
Waste of time, if conviction results it would be a cause to overturn the verdict.
...i think it could come down to whether theyre convinced the defendant did the murder or not. once convicted its an uphill battle pushing a boulder to get it heard again. all the judge would have to do is stipulate its not being submitted as proof merely submitted for their consideration as to the weight of it.
Not a parrot expert, but I have been around them. They can be almost like a recording. But establishing if it was the victim vs say, having been "coached", would be problematic.
"Mr. Parrot, could you please explain to the jury what happened that night?"
"Ahhhk! Don't stop! Don't stop! Uhhh! Yes! *snoring sound*"
