    A Nebraska inmate who has professed his allegiance to the divine Flying Spaghetti Monster lost his bid demanding that prison officials accommodate his Pastafarianism faith.


    A federal judge dismissed the suit (PDF) Tuesday brought by Stephen Cavanaugh, who is serving a 4- to 8-year term on assault and weapons charges at the Nebraska State Penitentiary. US District Judge John Gerrard ruled that "FSMism" isn't a religion like the ones protected under the Constitution.

    "The Court finds that FSMism is not a 'religion' within the meaning of the relevant federal statutes and constitutional jurisprudence. It is, rather, a parody, intended to advance an argument about science, the evolution of life, and the place of religion in public education. Those are important issues, and FSMism contains a serious argument—but that does not mean that the trappings of the satire used to make that argument are entitled to protection as a 'religion,'" the judge ruled.     He sued for 5 million because they wouldn't let him wear a pirate costume in prison! That's hilarious I would have let it go to trial

    No way. I love it. Much different than worshiping a dude was was dead but came back to life and was his own father who got his mother pregnant without even fucking her?

    I agree with you for sure.

    But there are plenty of Bible Belt goof balls, still talking to their imaginary friend in the sky, who get very upset by stuff like this. Which makes me so happy. These are the same people who go ballistic that "Christmas is under attack" because Starbucks had a red cup for the holidays.

    Seems a bit far fetched. I am all for mocking, hell that is why i am here. But i would never dress myself up with a wig, fake chin, and walk around in public to try and prove how stupid i think stern has become.

    Playing stupid seems like a stupid way to expose the stupid. :dontknow:

    So (1) Drinking wine believing that it turns into the blood of a dead Jewish street philosopher and gives you eternal life = Religion
    But (2) Believing in a flying spaghetti monster that has a heaven with a Beer Volcano and Stripper Factory = Parody.

    Hmmm. I'll tell you which one seems more rational on its face . . . or at least palatable. :D

    Agreed, but I think the judge's point was that satire doesn't hold the same protections under the 1A as do legitimately held religious beliefs.

    FSMism isn't a "real, respectable religion", like scientology, for example.
