    Henderson [Nevada, USA] police arrested a family for refusing to let officers use their homes as lookouts for a domestic violence investigation of their neighbors, the family claims in court

    "Defendant Officer David Cawthorn outlined the defendants' plan in his official report: 'It was determined to move to 367 Evening Side and attempt to contact Mitchell. If Mitchell answered the door he would be asked to leave. If he refused to leave he would be arrested for Obstructing a Police Officer. If Mitchell refused to answer the door, force entry would be made and Mitchell would be arrested.'"
    Officers then arrested him for obstructing a police officer, searched the house and moved furniture without his permission and set up a place in his home for a lookout, Mitchell says in the complaint.

    "Although plaintiff Anthony Mitchell was lying motionless on the ground and posed no threat, officers, including Officer David Cawthorn, then fired multiple 'pepperball' rounds at plaintiff as he lay defenseless on the floor of his living room. Anthony Mitchell was struck at least three times by shots fired from close range, injuring him and causing him severe pain." (Parentheses in complaint.)
    He says they also hurt his pet dog for no reason whatsoever: "Plaintiff Anthony Mitchell's pet, a female dog named 'Sam,' was cowering in the corner when officers smashed through the front door. Although the terrified animal posed no threat to officers, they gratuitously shot it with one or more pepperball rounds. The panicked animal howled in fear and pain and fled from the residence. Sam was subsequently left trapped outside in a fenced alcove without access to water, food, or shelter from the sun for much of the day, while temperatures outside soared to over 100 degrees Fahrenheit."
    of course none of the officers were ever subjected to official discipline or even inquiry, the complaint states.

    None of the officers were ever subjected to official discipline or even inquiry, the complaint states.
    The Mitchells seek punitive damages for violations of the third, fourth and 14th Amendments, assault and battery, conspiracy, defamation, abuse of process, malicious prosecution, negligence and emotional distress.

    If this is really how it reads, I hope they get a fortune. How are they making it a 3rd amendment case if no military troops were present?

    Cops these days are para-military. They possess weapons are under command of ranking officers. I hope beyond hope that the family doesn't take a settlement but instead takes this to the supreme court. Fucking cops assuming too much authority need to be smacked back in line. Better yet, disbanded.

    And all you folks who think the right to own a gun based on the idea that your own government will go rogue is a bad idea. Where is your argument now?

    Instead of punitive awards coming from tax revenue, I wish that, in cases like this, the officers involved would have to forfeit a significant portion of their salary as well. If it's not coming out of their pockets, they have every reason to throw caution to the wind.

    If this case went down like the plaintiffs claim, this is scary fucking shit. The only thing scarier is that there's a possibility that the current SCOTUS in favor of the police if the case makes it that far. They have already ruled that cops can install cameras on your property without a warrant.

    Yep, time to start making the bad actors in these cases pony up instead of the taxpayers. As it stands now police departments, school districts and other government entities can run their shit as badly as they want knowing full well that any malfeasance on their part will be paid for by the taxpayers.

    It's tough to believe this is even possible in the USA.

    If true, all involved should be fired, and the homeowner should be made a millionaire. We cannot allow our BASIC constitutional rights to be trampled. And being safe inside your own home is as basic as it gets.

    That may have happened in July 2011. 363 Eveningside is currently for lease. The above pictures I believe to be Christopher Dorner's street and home in Las Vegas when the police were looking for him.

    Not sure, but local PD's operate now more along the lines of little military units than practice community policing. Odd that small towns now have armored personnel carriers, military weapons, and all manner of tactical weapons and training. They have certainly forgotten their mission is to serve the community. DHS is encouraging this shift.
