    Customers and idiots that bought the stock have been repeatedly ass-raped by these white collar criminals!
    HUNDREDS were fired because of the merger.....and the rest fight for a few loose marbles!

    Howard is retarded. He wants bonuses for people that can't listen to him. He got bonus for all the xm customers that ordered best of Sirius.

    The contract is 100% clear.

    What I continually find baffling is why people don't seem to understand that the contract doesn't explicitly state that XM subscribers would count for the purposes of the bonus. Howard seems to think it is implied, but it is not actually stated in the contract. That is the point the judge was making in the ruling. Sirius clearly stated the terms of the $25 million merger bonus, but there is no mention of the XM subscribers. If Howard claims that they clearly promised him this then why is it not in the contract? And why did he sign it when it clearly isn't in the contract?

    What Hinkley and Howard don't understand, the real villans here are Don Buckwald and his agency's team of attorneys. The fact of the matter is that once they spelled out a bonus for a potential Sirius XM merger, they needed to spell out that all XM subscribers count towards his subscriber total bonus. That was his representation fault.

    Whether Howard saved Sirius or not or made the heads of the company rich is irrelevant to contract law.

    Usually when a case is dismissed at summary judgement, it is an open and shut case. If there is any grey area in a contract, usually the judge will let it go to trial. Maybe the spirit of the contract was violated, but seems pretty clear that Sirius acted within the letter of the contract. If the spirit of the contract was violated while the letter of the contract is not, it was because Howard's representative wrote a bad contract.

    luckily the court of public opinion has no say in this matter. Howard's antics will serve him no good here.

    Well, there was one thing Howard said that sort of resonated. It's that if you ever try to sue your employer, they will almost always the money and resources necessary to crush you like a bug.

    i think howard is very smart, and so is his agent and lawyers. therefore, if that was their intent, gary the retard would be able clearly read it in the contract.
    he's been successful in the past with settlements, and i think that's what they were going for here. even a 15% settle would be 45 mil.
    i doubt he even risked any funds for the long shot gamble
