In a recent op-ed for Slate, one of the most influential Judges in the country, Reagan appointee Seventh Circuit Judge Richard Posner, also a senior lecturer at the University of Chicago Law School and a fucking traitorous cunt, spoke about the Constitution, the Bill of Rights and the Amendments.

"I see absolutely no value to a judge of spending decades, years, months, weeks, day, hours, minutes, or seconds studying the Constitution, the history of its enactment, its amendments, and its implementation. Eighteenth-century guys, however smart, could not foresee the culture, technology, etc., of the 21st century. Which means that the original Constitution, the Bill of Rights, and the post–Civil War amendments (including the 14th), do not speak to today. Let’s not let the dead bury the living.

Posner took the following oath as a requirement to sit on the Court of Appeals:

"I, ___ ___, do solemnly swear (or affirm) that I will administer justice without respect to persons, and do equal right to the poor and to the rich, and that I will faithfully and impartially discharge and perform all the duties incumbent upon me as ___ under the Constitution and laws of the United States. So help me God."

Remove him from office. Or shoot him dead as a threat to national security.

On every question of construction, let us carry ourselves back to the time when the Constitution was adopted, recollect the spirit manifested in the debates, and instead of trying what meaning may be squeezed out of the text, or invented against it, conform to the probable one in which it was passed. -Thomas Jefferson

Do not separate text from historical background. If you do, you will have perverted and subverted the Constitution, which can only end in a distorted, bastardized form of illegitimate government.
    – James Madison

The Constitution is a written instrument. As such, its meaning does not alter. That which it meant when it was adopted, it means now. – South Carolina v. United States, 199 U.S. 437, 448 (1905)

Nothing can destroy a government more quickly than its failure to observe its own laws, or worse, its disregard of the charter of its own existence. –U.S. Supreme Court, Mapp vs. Ohio

Posner famously hated Scalia with a passion.

All he said is the world has changed a lot since it was written, and that needs to be factored in.

IMO no one is in a 'Militia' in 2016.

What is the militia? It is the whole people, except for a few public officials. – George Mason, member of the Constitutional Convention, co-author of the Bill of Rights

We didn't even have a standing Army or police force when the Militia thing was drafted. It's nonsensical in 2016, a guy buying an AR-15 is not in a Militia.

I get the right to a gun for personal protection and hunting etc but the rest is bullshit.

We didn't have an army in 1788? What was the continental army then? Boston has had a police force since the early 1600's. Fucking retard.

Not a standing Army, nope. You're not in a Militia, so sorry.

The continental army was a standing army and it predates the constitution. Straw man all you want about it.

The people that wrote the constitution plainly wrote that a militia is the "whole people". Whine about that all you want, too.

Facts suck when desperately trying to bend them around your worldview, don't they, Balls?

How ironic that a guy in the militia, doesn't realize he's in the militia. :dontknow:

Well, that assumes that you're at least 16 years of age and of sound mind...

Twist it however you want, the US Military isn't augmented by a pretend 'Militia' of rednecks with AR's in 2016.

If you want to join the National Guard, fine. Otherwise, Billy Bob isn't in a 'Militia.'

The irony is, wingnuts think they need AR's to fight the Military.

Those are, without question, two legitimate activities protected by the 2A. But neither is the justification that was most important to the Founding Fathers.

For them, the single most important activity protected by the 2A was the right of individual persons to gather together freely, as they alone deemed necessary, for the purposes of taking up arms against any oppressor - be it foreign, or originating within the ranks of our very own federal government. In fact, this right to take up military arms against your government was so crucial in their estimation, that they actually added a phrase to the 2A to specifically protect it.

And that is the story of how you became a militiaman. Embrace it, because it makes your citizenship unique in all the world. :)

That scenario for the existence of a 'Militia' no longer exists. And good luck if you think you'll take on the 2016 US Military with an AR-15.
