    No, they're protected by extremely expensive malpractice insurance and a hospitals ability to pay for the lawsuit to go away.

    For my ACL surgery they had me circle the kneecap and sign my name with a sharpie and they recorded me doing it with a little Flip cam.

    not in Texas, there's a cap on non economic damages, so the guy can get $750,000 for the doctor's stupidity, and that includes punitive damages :party: tort reform.


    How much would you want to live on dialysis for the rest of your life?

    ill jump in on that. you wouldn't. it's complete hell. 3-4 times a week 4 hours a day. pain dizziness, can't breathe, always tired, cant eat or drink anything.

    no lawsuit settlement is worth the hell i go thru. if someone handed me a billion dollars i'd still be miserable. granted i'd fly all over the world for a chinatown kidney, but otherwise it sucks big time!

    Nobody would begrudge this person millions. It's sad that you would use a serious case like this to defend the frivolity of the vast majority of lawsuits.

    In 2010, the Office of Inspector General for Health and Human Services said that bad hospital care contributed to the deaths of 180,000 patients in Medicare alone in a given year. Now comes a study in the current issue of the Journal of Patient Safety that says the numbers may be much higher 2014 between 210,000 and 440,000 patients each year who go to the hospital for care suffer some type of preventable harm that contributes to their death, the study says.

    and when the known serial liar Obama get his hands on hospitals, it will get worse- much worse. oh, yeah just like the VA hospitals they now run- veterans have died waiting for years on secret waiting lists, and the politicians are lying full speed to cover it up. Welcome to the future of our "affordable" healthcare.
    It's really unbelievable how bad things are.
    Government cannot run anything without fucking it up. Say that over and over until it sinks in.

    That's nothing. I went into the hospital to have my tonsils removed and the doctor thought I was having my testicles removed. Boy did we have a good laugh after the surgery.

    BTW, they still let me eat all the ice cream I wanted after the surgery. Which was nice.

    Not to mention almost implying that he'd get just $750,000. Economic damages, still fully allowed, would range into the millions depending on how old he was and how many more years of working he had left, his income level, the medical costs involved, modifications to his home, etc, etc. In-home dialysis would not be out of the question here.

    I could see the guy getting $3-5M. Hardly nothing. While I don't approve of such low caps, we should remember that it was an ACCIDENT, not intentional.

    Meanwhile, many people who claim to be "compassionate" essentially support NO damages be paid by criminals who harm others, because they're the poor poor pitiful poor. Alll their compassion is spent by the time a victim of crime comes asking for restitution. A system that makes criminals work off their debts to victims before they were released from prison or probation is constantly shouted down by these same "compassionate" people as inhuman and "cruel and unusual".

    How many lives would be saved from ruin if a guy who decided to rape a woman knew he'd either have to remain in prison for life or report to a labor detail after his first job for the rest of his life to pay his restitution? If a dude who stole a car and crashed it running from the cops had to repay every cent of the damage he did before he was allowed a weekend off? This is willful behavior, not accidents. But nope, THAT kind of damages don't put 1/3 of the money in a lawyer's pocket. So no go.

    Va has always been fucked up. The horror stories I can tell after working there 10 years in the early 1970's. It's much better now
