If one was to prepare a class action against Howard and Sirius, what would you base it on? Me, I would dig deeper into the collusion between Howard and Mel to bilk the company and the listeners out of billions. There's a false advertising element to it that might not stand on its own, but definitely helps make the case that Howard and Mel were in cahoots and intended to scam the listeners. Include with that the faulty equipment, deceptive business model, hours of commercials etc and there's a lawsuit there. one could also make a case for stock manipulation. T could be tied back to Howard using te record from his recent lawsuit (where he, himself, claims to be a partner, not just an employee) and who could argue that Howard fraudulently pushed the merger? One could also use Howard's constant flip floppig between "I'm a partner" and "I'm just an employee" as well as his leaked contract to indicate that he knew full well what he was Doing... what's your thought? Also, why hasn't someone filed yet?
