The family of a toddler who was killed after an alligator snatched him at a Disney resort has decided not to sue.

"Melissa and I are broken. We will forever struggle to comprehend why this happened to our sweet baby, Lane," Matt and Melissa Graves said in a statement Wednesday. "As each day passes, the pain gets worse, but we truly appreciate the outpouring of sympathy and warm sentiments we have received from around the world."

The Graves said they intended on keeping two-year-old Lane's "spirit alive" through a foundation they created in his memory. "In addition to the foundation," they said, "we will solely be focused on the future health of our family and we will not be pursuing a lawsuit against Disney."

Lane was dragged underwater at a beach area near Disney's Grand Floridian Resort & Spa on June 14 as his horrified parents looked on. Authorities said his father tried to wrestle him away from the alligator, but couldn't. Matt Graves later told officials he was attacked by a second alligator as he tried to save Lane.

That's good, it's hard to get a gator to go to court anyway.

They're smart. Why drag yourself through it all over again. I've never sued anyone for this very specific reason. My mental health is not for sale.

I can understand why they aren't at the stage of full understanding yet, but eventually they will have to come to terms with their responsibility.

Congrats on not taking it to court, wouldn't want to face Disney's legal team and I think they realize that they have no case.

I'm sure Disney gave them a lot of money towards their charity and if you lost a kid.. nothing will make up for it... not even millions.

and really if they went to court I'm pretty sure Disney would make them out to look like unfit parents and make them completely question their choices right or wrong.

It's a very tough case, and it would be an ugly one too, if it were litigated.

You're right. No money can replace my kid. But 15mill we'll keep me busy enough to not think about it

You don't think Disney would throw a bunch of money at them?

If the resort were in Minnesota, that's one thing, but Florida? alligators are presumed to be in every body of fresh water

Wow. I'm generally *very* anti lawsuit in most matters. But this seems very clear cut to me. There were dangerous predators who can and often do attack AT the shoreLINE in the water near beaches Disney promotes as a feature and no proper warnings or barriers.

Cue the "But there was a no swimming sign!" ppl.

There was no sign there. There is now. They admitted liability by doing that :grad:
