    A former Blount County teacher set to go to trial Tuesday on a charge that he had sexual contact with a student, whom he later married, is challenging the constitutionality of the state's law banning school employee sex with students under the age of 19.

    Attorneys for Matthew Wester on Sunday filed a challenge to the constitutionality of the school employee law, and requested dismissal of the charge against him, according to court records. The challenge and request was filed by Wester lawyers, J. Robert Bentley and J. Stanton Glasscox, at 4:39 p.m. Sunday. As of Sunday evening, Madison County Circuit Judge Dennis E. Odell, appointed to hear the case because all Blount County judges recused themselves, had not responded to the request.

    Wester was indicted in January 2015 on one count of a school employee having sexual contact with a student under the age of 19. Five months later, Wester married that student, Amy Nicole Cox, who was 18 at the time.

    A math teacher and coach at Cleveland High School, Wester was placed on paid leave in November 2014 amid the allegations. According to the indictment, Wester "intentionally and knowingly engaged with a male or female student under the age of 19 in sexual contact which was done for the purpose of gratifying the sexual desire of either party, to wit- kissing and spending the night with the victim.

    Wester taught 10th Grade Advanced Geometry, 11th Grade Geometry, 12th Grade Algebraic Connections and 9th Grade Algebra. He was also an assistant varsity coach, head track coach and a graduate of Cleveland High School.


    Earlier this month, Blount County District Attorney Pamela Casey filed a motion claiming the marriage was a sham designed to keep Cox from having to testify against her now husband. "On June 13, 2015, just 67 days following the divorce from 'wife No. 1,' and less than five months prior to the initial trial setting in this matter, the defendant married the student whom he subjected to sexual contact while he was a teacher and she was student,'' Casey wrote. "It is the state's position that the marriage to the student is a sham by the defendant to prevent the student from testifying against him."

    In the court motion, Casey wrote she expected the student to claim the marital privilege under Alabama law, which says the husband and wife may testify either for or against each other in criminal cases, but "shall not be compelled to do so." Casey contended no marital privilege exists for the student and Wester because, according to case law, there is no privilege where one spouse is charged with a crime against the person of the other spouse. "Thus, because the student (now wife No. 2) was a victim of Wester's, the privilege does not exist."

    Judge Odell on April 18 said he reviewed the motions, the arguments of the attorneys and the applicable law and found the state's motion to compel Cox to testify was "well-taken." He cited court cases that backed up Casey's argument that marital privilege should not apply to statements relating to a crime where a spouse or a spouse's children are the victims. "Therefore, the court determines that there is no spousal privilege barring the testimony of the defendant's current wife in that she is the victim in this case,'' Odell wrote. "Her testimony is hereby compelled."

    According to court filings, Cox's diary is among evidence to be presented at trial. Prosecutors expect "a majority of (the) evidence to be that of the victim and statements the victim made to others about her relationship and contact with the defendant."

    "The state has learned that the defendant and victim had secret phones to communicate with one another,'' according to filings. "Wife #1 (Wester's now ex-wife) located the phone held by the defendant and smashed it to pieces when she found out her husband was carrying on a relationship and communication with a student."

    The judge on April 20 issued a gag order in the case, prohibiting attorneys on both sides from commenting about the case to the media, court records show.

    The challenge filed Sunday is similar to two others filed recently in Alabama. Earlier this month, attorneys for Carrie Cabri Witt filed a challenge to the constitutionality of the school employee law. Witt, 42, a history, psychology and social studies teacher at Decatur High School, was arrested in March for having a sexual relationship with two male students, both of whom were 17 at the time of the alleged acts. She also coached girls' golf and junior varsity cheerleaders, according to the school's website.


    In March, attorneys for Joe Bradley Petrey, 28, of Northport, filed a similar challenge. Petrey was charged in August under the school employee sex law for having sex with an 18-year-old female student.


    The motions in all three cases say teachers' 14th Amendment equal protection rights to not be treated differently than other classes of citizens is being violated by the state law enacted by the Alabama Legislature in 2010. Other adults having consensual sex with 16-year-olds do not face criminal prosecution, the lawyers contend.

    The age of consent for sexual relationships is 16 in Alabama, as long as the 16-year-old was not forced, or has a mental condition that would prevent them from making a decision. The law, however, says that consent by a student for a sexual relationship with a teacher is not a defense.

    "Wester has plead (sic) not guilty to the indictment and therefor does not in any manner agree with, or stipulate to, the factual accuracy or correctness of the purported facts set out in the indictment,'' his attorneys wrote. "But the statue (sic) upon which the indictment is apparently based is flawed and must be challenged."

    "The fact that Alabama singles out an ever-growing number of 'school employees' and then treats them differently than any other citizen...is at the heart of the defendant's Equal Protection Challenge,'' they wrote. "Among many ways, Alabama might have protected students from their own consent, the way chosen by the Alabama Legislature needlessly intrudes upon the privacy of school employees in a way that denies them due process and equal protection of laws

    It is an interesting challenge, why single out teachers? There are many professions where the argument could be just as compelling, doctors, therapists, those who use interns. :dontknow:
