    ...the prosecutor uses a grand jury for a few reasons. the defense cant defend itself or question the d.a.s witnesses. it sounds like they want to put him on trial hence looking for the g.j. to rubber stamp the notion that there is probable cause that a crime has been committed. if the d.a. went to a preliminary hearing the defense would know what the d.a. strategy is and also have to convince the judge that there was probable cause to go forward to trial. with the d.a. using a g.j. it looks like hes going to trial. tony stewart is a smug mofo anyway with a hot temper, let him prove it was an accident.

    Gawd! If that goes to trial, imagine the media circus that will be, could it ever be a fair trial? Especially with local yokoms as jurors that want to teach the rich city folk a lesson! :facepalm:

    Don't read too much into this.
    It's common for any potential homicide to be given to the Grand Jury.
    Here in Texas, all shooting deaths go to a Grand Jury regardless of the circumstances.

    He'll be no-billed and it will be forgotten quickly.

    So does this sort of kill two birds with one stone then? The grand jury determines what the charges will be and delivers the indictment all at the same time?


    If this strategy gives the D.A. the advantage of not having to show his hand, so to speak, and temporarily bypassing the judge, why don't they prosecute all their cases this way? Does this method give the grand jury more latitude in determining what the charges will be than D.A.s would like to grant in most cases?

    Under New York State law, unless the defendant consents, all felony cases must be presented to the Grand Jury.

    It's a death caused by another person, technically a "homicide". This is no different than when a cop shoots a bad guy and is justified. The grand jury still convenes to confirm it.

    ah ny state does it differently. that must keep grand jourors pretty busy with a felony committed every minute in ny state.

    I mentioned this story yesterday to a guy I saw who races sprint cars. I hadn't seen him since the incident and wanted his opinion. He immediately jumped all over the kid and said the first thing you are taught is to never leave your car unless it is on fire. He said at the tracks where he races, they will toss you out of the track if you leave your car.

    He also said that there is another video shot from head on that shows the kid actually climbing on Stewart's car. I told him I hadn't heard about this other video but he insisted that there is one.
