    Seems Trump is throwing a little shade at Ted Cruz and his foreign birth. Says it would be precarious for Republican party if he was nominated. Wouldn't want to see him tied up in the courts over it.

    This is getting so good.

    I thought Cruz was confirmed to have been born in Canada, does that not automatically disqualify him for President ?

    Not automatically. Issue turns on what it means to be a "natural born citizen." Article II speaks of restricting Presidential eligibility to "Natural born citizens [and those who were so at the time of the Adoption of the US Constitution]." However, the 14th Amendment further states that "All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside." The problem is that the courts in the late 19th century heavily emphasized the "subject to the jurisdiction" part--meaning birth within a geographical area controlled by the US, which Canada obviously is not. Yet, statutes passed by Congress have generally provided that any child born overseas to US parents is a US citizen. Cruz's mom is/was from the US. But is being a US citizen for general purposes the same as being a "natural born citizen?" Maybe not. But the courts in recent years have stayed clear of this stuff, whether McCain and his Panama Canal birth or the challenge to Obama's birth.

    My guess is he is fine. The courts won't touch this; or if they do, it would have to be soon (though, here again, running for office is separate from being eligible for the office).

    McCain, and Goldwater for that matter, were fine because they were born on American Territories*. While not a state, it was U.S. land and they were born to American citizens to boot.

    Cruz, not so much. If he was a democrat born in Cairo as opposed to a tea partier born in Calgary, I can't imagine the GOP types would be so understanding of his situation.

    (*Panama Canal Zone was a U.S. Territory through 1999).
