WTF Used Car question

    A cousin of mine , bought a used car ( BMW 5 series 2011 70,000 miles) 3 months ago . When buying the car, he was adamant that he would only buy the car if there was a warranty attached to it. He got a 3 year / 36 , 000 mile warranty for 4 thousand $.

    He had some issue with the car , so went to the dealer to check it. To his surprise now, the warranty was rejected by the company it was bought from.

    The dealer never informed him till now nor told him about the application for warranty when buying the vehicle.

    When he went to car showroom , the dealer is now saying that ," do not play any tricks on me , as you have signed a clause where it says , you still own the car if your warranty is approved or rejected. "

    Is he screwed ?

    A lot of the extended warranties have a cancelation clause that lets you opt out if you don't use it. Read the fine print and only buy an extended warranty from the manufacturer of the vehicle. Most of those policies aren't worth the paper they're written on.

    The loopholes they leave themselves for denying a claim are crazy. And when they do pay out they often force the shop to use salvage parts to do the repair. They're garbage.

    Did the dealer refund the $4,000? He may still own the car, but I can't see why the company would be entitled to keep the money for the warranty if they rejected it. Something's amiss here. He would be wise to consult an attorney. In addition to actual damages, if the company is acting fraudulently (e.g., they kept the $4k for the warranty, despite knowing it got rejected) they might also have to cough up punitives. That can be a great bargaining chip. If it's bad enough, they could even be subject to criminal liability. If he's got a leg to stand on, he needs to put the fear of god into them until they do the right thing. An attorney can help.

    Never buy a warranty on anything. There's a billion different fucking loopholes I bought a warranty on a washer and dryer and paid $1k and the warranty is null and void because I had to help the technician install the shit in my house.

    Never get a warranty.

    Never buy a used luxury- too expensive to maintain once parts start wearing out - 4k would been more than enough to cover any repairs in 4 years and that doesn't cover wear and tear.

    I bought a relatively new used car about 6 months ago and was bombarded with warranty applications in the mail for months...Now you have to ask yourself why

    My ex-in-laws bought a Subaru which croaked about three miles after the warranty. They were glad to have purchased an extended warranty.

    This is why I always lease, 3years and it covers the length of the original manufacturers warranty..
    then start all over again...
    Have a lawyer throw out a letter, it will cost them
    More to litigate than it will to refund the money.
