    Walmart Pays $10 Million to Family of Comedian Killed in Tracy Morgan Crash

    WHITE PLAINS — The children of James McNair, a comedian who was killed in the New Jersey Turnpike crash that injured Tracy Morgan, are getting a $10 million settlement from Walmart, court papers show.

    The documents also show that the children — Jamel McNair, 26, and Denita McNair, 19 — are putting part of the payment toward annuities that will pay them ever-increasing monthly sums, starting at $3,000, for the rest of their lives.

    The $10 million figure was disclosed in documents filed in Surrogate’s Court in Westchester County, where James McNair lived before the June 7 crash. A Walmart truck hit a limousine van that was carrying Mr. McNair, Mr. Morgan and others home from a show in Delaware.

    A portion will be an annuity, not sure how much Walmart will have to come out of pocket, but it will be peanuts

    Wal-Mart has a general policy of fighting lawsuits to the death. They must have assessed that they were obviously liable on this one.

    I'm sure Walmart is devastated that they have to pay the profits that they earn in 10 minutes to this family.

    With lawyer's fees and the fact that the media probably don't understand the time value of money, it's likely a lot less than that, especially if much of it is an annuity.

    And they'd better hope we don't get high inflation down the line or it could really wind up being peanuts.

    Just raise the price of everything in all their stores by a penny and that should cover the loss.
