    Bringing a gun loaded with blanks.

    LAWNDALE (WPVI) --
    Authorities have released the name of the suspect who was shot and killed by police after allegedly firing blank rounds at an off-duty officer during a robbery attempt in Philadelphia's Lawndale section.

    The man is identified as 33-year-old Andrew Ellerbe from the 2300 block of North Garnet Street.

    The incident happened just before 11:30 p.m. Thursday in the 6900 block of Rising Sun Avenue.

    Philadelphia Police Chief Inspector Scott Small said the detective had just ordered food at Rising Sun Pizza when Ellerbe and another man walked in.

    They allegedly took $20 from the detective's hand and Ellerbe allegedly put a gun to his head while forcing him to the ground.

    The suspects then turned around to the counter where the owner and employee were standing. The officer identified himself and pulled out his gun.

    Police say Ellerbe then fired two shots at point blank range at the officer.

    The detective returned fire, and hit Ellerbe who later collapsed on the 500 block of Tyson Street and died.

    Action News has learned Ellerbe's gun was a 6-shot revolver loaded with blank rounds.

    The weapon contained two fired blank cartridges and four live blank cartridges, according to police.

    Video obtained from the restaurant depicts muzzle flash from the weapon when the suspect fired it at the detective.

    That detective fired back with his Glock.

    "He did what he had to do and his actions were nothing short of brave. Unfortunately somebody died but he defended his life and the lives of others," said Deputy Commissioner Richard Ross, Philadelphia Police.

    The second suspect fled and remains at large.

    The incident is under investigation.

    The DA in Baltimore just charged everyone in Philly with homicide for not knowing the gun was loaded with blanks.

    The deceased robber was loading the blanks into the gun and thinking how brilliant he was because no one could prove he had intent to kill because the gun was full of blanks and not live ammo. He saw for a moment the jury at his trial reading the verdict in a hushed courtroom, "Not Guilty!" they said as he was congratulated by his family and friends. Unfortunately, failing to realize there is a police officer who will respond with equal force when staring into this gun's barrel and hearing the discharge of bullets aimed for his head, the robber's last thought was what a moronic miscalculation he made.

    One downside for the cop is that his ears are probably still ringing.

    yup:

    expecting someone in a live fire situation to determine that the loads are blanks is naive and beyond stupid

    he was put in the situation of having to defend himself and others against deadly force. that justified his response.

    police are always expected to respond to situations that require a police response even when not "on duty". that's why by law they have to carry their service revolver all the time they are out, not just when they are on shift.

    you ever try that? it only works on TV. in a live fire situation when civilians are at risk, you target center mass and you double-tap. your goal is to protect the civilians, not to insure the threat is unharmed.

    i suppose the defense could claim he could not afford real loads because he was an oppressed minority. thus he should not have lost his life because his ancestors were slaves and as a result he did not have the opportunities whites have to earn sufficient income to buy real loads.

    of course the entertainment value of such a defense would rival that of Colin Ferguson.

    oh all 6? someone really hated this guy. cops need to investigate his gf/bf. it would take a special kind of naive stupidity to load blanks into a gun and attempt a robbery in a city. Not too sure about Philly but in many parts of the country committing a crime with a gun is sufficient intent to justify being shot by the police. your motivation for carrying the gun is implied by your carrying the gun. what you load it with has nothing to do with it.
