    ...the news didnt mention an appeal. it will not be easy if the gun store is granted an appeal to overturn the jury unless the judge made a huge mistake during trial. this will put all gun shop owners in a position of liability if they continue to sell guns to strawman buyers.

    Nope, straw pirchase wont be overturned and its a civil case not criminal case.

    and how exactly is a gun dealer supposed to background check that scenario? at some point reality has to kick in. are car dealers going to be held responsible for DUI fatalities? are hardware stores going to be held liable for selling rope and poisons? is target going to be held responsible if a knife they sold is used to kill?

    I'm all for real world solutions to calm the proliferation of guns but you've also got to be sensible about this. secondary selling of guns (legally and illegally acquired) is the bigger problem. find the study done of Cook County Jail inmates and the majority of the guns used by those people came from street sources. as one guy put it, every neighborhood has a "clean" guy who goes buys guns for the rest of the neighborhood. worry about THAT GUY - not a legal, licensed and monitored gun shop

    ...evidentally the lawyers proved they should have done more to vet the buyer. the gun store in the lawsuit had over 400 incidents where guns coming from their store were involved in a crime. the closest 2nd to them was a store with 39 incidents of guns coming from their store being involved in a crime.

    so somebody(s) with a clean record bought 400 guns that were later used in crimes? a background check was done right? were the guns stolen from the store and not reported? again, if you are a gun store owner, and somebody walks in and passes a background check how are you supposed to know?

    if you need to shut the business down as a public nuisance then I'm ok with that. shutting it down by this method I have a problem with

    Authorities have said more than 500 firearms recovered from crime scenes had been traced back to Badger Guns and Badger Outdoors, making it the "No. 1 crime gun dealer in America," according to a 2005 charging document from an unrelated case. A former federal agent has also said the shop had failed take necessary precautions to prevent straw purchases.
